Information regarding the processing of personal data by CARGOUNIT sp. z o.o.

I. Information notice in the event of personal data being collected directly from the data subject

  1. The controller of your personal data is CARGOUNIT Sp. z o.o., with its registered office in Wrocław, ul. Na Ostatnim Groszu 3, 54 – 207 Wrocław, daneosobowe@cargounit.eu, tel. 71 350 9707
  2. Your personal data will be processed for the purpose of performing the Contract, namely:
    • to comply with the controller’s legal obligations in accordance with Article 6(1)(c) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 – on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the GDPR) – in respect of personal data contained in documents subject to archiving under the provisions of the law;
    • for the purposes of pursuing the controller’s legitimate interests in accordance with Article 6(1)(f) of the GDPR, i.e. the proper performance of the Contract/Agreement, including archival (evidential) purposes which constitute the pursuit of the controller’s legitimate interest – safeguarding information in the event of a legal need to demonstrate facts, and in particular for the purposes of any investigation, pursuing or defending against claims.
  3. The recipients of your personal data will be:
    • public authorities and entities performing public tasks or acting on behalf of public authorities, to the extent and for the purposes required by generally applicable law;
    • third parties, to the extent that personal data is necessary for purposes arising from legal provisions;
    • entities that process personal data on behalf of the controller, on the basis of a data processing agreement (processors);
    • entities authorised to receive personal data pursuant to relevant legal provisions;
    • the controller’s employees;
    • persons acting on behalf of the controller under separate contracts, who are obliged to maintain confidentiality regarding the personal data provided.
  4. Your personal data will not be transferred to a third country or an international organisation.
  5. Your personal data will be stored for the period necessary to achieve the purposes set out in point 2, and thereafter for the period and to the extent required by generally applicable law, as well as for the period until the expiry of the limitation period for claims arising from the contract referred to in point 2 of this clause.
  6. In accordance with the terms and conditions set out in the GDPR, you have the right to access your personal data, as well as the right to rectify, erase, restrict the processing of, and transfer your data, and the right to object.
  7. The processing of your personal data is necessary to achieve the purposes of processing set out in point 2; therefore, the provision of your personal data is voluntary, but necessary for the performance of the tasks described in point 2, including the fulfilment of obligations arising from the Agreement and from legal provisions. Failure to provide your personal data may result in the inability to achieve the purposes set out in point 2, including the non-performance or improper performance of obligations arising from the Agreement.
  8. You have the right to lodge a complaint with the supervisory authority (i.e. the President of the Personal Data Protection Office) if you consider that the processing of your personal data infringes the provisions of the GDPR.
  9. Your data will not be subject to decisions based solely on automated processing, including profiling.

II. Information notice in the event of personal data being collected directly from Information notice in the event that personal data is collected indirectly from the data subject

  2. Your personal data will be processed for the purpose of performing the Contract, i.e.:
    • to comply with the controller’s legal obligations in accordance with Article 6(1)(c) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 – on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the GDPR) – in respect of personal data contained in documents subject to archiving under the provisions of the law;
    • for the purposes of pursuing the controller’s legitimate interests in accordance with Article 6(1)(f) of the GDPR, i.e. the proper performance of the Contract/Agreement, including archival (evidential) purposes which constitute the pursuit of the controller’s legitimate interest – to safeguard information in the event of a legal need to prove facts, and in particular for the purposes of any determination, investigation or defence against claims.
  3. The recipients of your personal data will be
    • public authorities and entities performing public tasks or acting on behalf of public authorities, to the extent and for the purposes set out in generally applicable law;
    • third parties, in respect of personal data necessary for purposes set out in law;
    • entities which process personal data on behalf of the controller, on the basis of a data processing agreement (processors);
    • entities authorised to receive personal data on the basis of relevant legal provisions;
    • the controller’s employees;
    • persons acting on behalf of the controller under separate contracts, who are obliged to maintain confidentiality regarding the personal data provided.
  4. Your personal data will not be transferred to a third country or an international organisation;
  5. Your personal data will be stored for the period necessary to fulfil the purposes set out in point 2, and thereafter for the period and to the extent required by generally applicable law, as well as until the expiry of the limitation period for claims arising from the contract referred to in point 2 of this clause.
  6. Under the terms and conditions set out in the GDPR, you have the right to access your data, the right to rectify it, the right to erasure, the right to restrict processing, the right to data portability, and the right to object,
  7. you have the right to lodge a complaint with the supervisory authority (i.e. the President of the Personal Data Protection Office) if you consider that the processing of your personal data infringes the provisions of the GDPR;
  8. your personal data has been provided to the Controller by a party to the Contract/Agreement;
  9. Your data will not be subject to decisions based solely on automated processing, including profiling.
